Below is the new legal update from Mumia Abu-Jamal’s lead attorney Robert R. Bryan, concerning Mumia’s appeal to the US Supreme Court. He is appealing the US Third Circuit Court decision denying a new guilt-phase trial or a preliminary hearing that could have led to a new guilt phase trial. The Supreme Court granted Bryan’s request for a 60-day extension, so he will have to submit his petition by Dec. 19, 2008. Significantly, Bryan announces that the Philadelphia DA is appealing the Third Circuit Court’s affirmation of US District Court Judge William Yohn’s 2001 decision, which ‘overturned’ the death penalty and stated that if the DA wants to re-impose the death sentence, they must hold a new penalty-phase jury trial where new evidence of Mumia’s innocence can be presented, BUT, the jury can only decide between a sentence of life without chance of parole or execution. Therefore, if the US Supreme Court rules for the DA and overturns this ruling, Mumia can then be executed without having a new penalty-phase jury trial. I just watched on YouTube a video clip taken outside a rally for Sara Palin in Johnstown, Pennsylvania, a town where I worked for thirty-two years. The crowd was raucous and racist, blithely spitting out vile remarks. Congressman John Murtha later told a Pittsburgh newspaper that 'There’s no question western Pennsylvania is a racist area. ...' Murtha was roundly chastised for his comments, mainly by Republicans, which had to mark a new height in irony. Murtha, sad to say, was right on the mark. The financial crisis that has been heating up since early 2007 reached the boiling point in late September. Credit markets virtually stopped functioning. A full-blown panic swept stock markets worldwide. The U.S. economy is in the throes of a recession that could turn into a Depression lasting for years. In these dire straits, the Wall Street speculators who set off this crisis are demanding that the government rescue them with a bailout priced at $700 billion. The actual costs will be far higher, a trillion dollars or more. Meanwhile, the Democrats are pushing hardest for the Bush bailout of the banks. Presidential candidate Barack Obama blames "greed" for the crisis on Wall Street (capitalism without greed?) and says there must be no "blank check to Washington" -- meaning he's for putting in a few conditions as window dressing. Following in the Democrats' footsteps, the AFL-CIO labor bureaucrats called a demo for "No Blank Check for Wall Street." Yet no amount of regulation will stop the boom-bust cycle of capitalism. Meanwhile unemployment lines are growing and a million families were thrown out of their homes by bank foreclosures in the last year. While the fat cats, Democrats and bureaucrats are all going for the Bush bailout to prop up U.S. capitalism, revolutionary Marxists oppose this trillion-dollar giveaway to the Wall Street speculators, calling instead for a program of transitional demands leading to the expropriation of the banks and the entire bourgeoisie through workers revolution. The heavily Democratic crowd booed McCain when he called for the Reserve Officer Training Corps (ROTC) to be brought back to campus (it was driven out in 1969 by protests against the Vietnam war). Liberal students expected a different answer from Columbia alum Obama, but the forum was a symphony of agreement as both candidates campaigned for expanding the military and pledged their enthusiastic support to U.S. imperialism. That should have been the tip-off for anyone who hadn't figured it out by then: Obama is no "peace candidate" but like McCain he is a certified imperialist war candidate. (text/html)
